More than 500 Labour Hire Licences have been cancelled by the Victorian Labour Hire Authority (LHA) in FY24 as part of a “significant year for LHA compliance and enforcement”.

What is the Labour Hire Authority?

The Labour Hire Authority is an independent statutory authority responsible for licensing and regulating labour hire services in Victoria.

The labour hire industry in Victoria (VIC) is regulated by the Labour Hire Licensing Act 2018 (VIC) (VIC Act) and the Labour Hire Licensing Regulations 2018 (VIC).

LHA protects Victorian workers from exploitation by hosts and providers of labour hire services, and works to improve the transparency and integrity of the labour hire industry.

What is a labour hire provider?

The LHA defines a labour hire provider as an individual or organisation that:

  • supplies workers and pays them to perform work in and as part of a host’s business
  • recruits workers for a host and provides accommodation, and/or
  • recruits workers as independent contractors for a host and manages the contract performance.

What is a labour hire host?

A labour hire host, as outlined by LHA, is a business that engages workers through a labour hire provider. Workers supplied to perform certain activities are also considered labour hire workers, including:

  • cleaning commercial premises
  • performing certain horticulture activities
  • performing certain activities in a meat or poultry manufacturing or processing plant.

Who is a labour hire worker?

Labour hire workers are generally individuals employed and paid by labour hire providers and supplied to host businesses, farms or organisations on a full-time, part-time or casual basis. The employment, obligations, and risk fall on the labour hire provider.

Why is a Labour Hire Licence important?

Labour Hire Licenses prevent the exploitation of workers by labour hire providers, ensuring that providers meet a minimum standard of safe and fair working conditions. This includes pay rates, compliance with employment law and regulations, adherence to all legalities and ethical operations.
